Wyoming's stay-or-pay law
W.S. § 1-23-108, from SF0107 (Chapter 170, Session Laws 2025). It applies to contracts signed on or after July 1, 2025.
Law in force Caps for contracts from July 1, 2025.
Wyoming made most noncompete agreements void for contracts signed from July 1, 2025. The same law lets an employer recover what it spent relocating, educating and training you, but only on a sliding scale by how long you stayed.
What it means for each kind of repayment
For contracts signed on or after July 1, 2025:
Training costs
Only with conditions
- Up to 100% of the cost if you leave in your first 2 years.
- Up to 66% if you leave after 2 years but before 3.
- Up to 33% if you leave after 3 years but before 4.
- Nothing after 4 years (our reading: the law gives no share past 4).
A sign-on bonus
Not covered
- Wyoming's law caps the cost of relocating, educating and training you. It says nothing about bonuses.
Relocation money
Only with conditions
- Up to 100% of the cost if you leave in your first 2 years.
- Up to 66% if you leave after 2 years but before 3.
- Up to 33% if you leave after 3 years but before 4.
- Nothing after 4 years (our reading: the law gives no share past 4).
Tuition or a course you chose
Only with conditions
- Up to 100% of the cost if you leave in your first 2 years.
- Up to 66% if you leave after 2 years but before 3.
- Up to 33% if you leave after 3 years but before 4.
- Nothing after 4 years (our reading: the law gives no share past 4).
A fee or penalty for leaving
Not settled
- A fee for leaving isn't one of the costs the law allows an employer to recover, so it may be a void restraint, but no court has said.
What the law leaves out
- Executives and management staff, and their professional staff.
If your contract breaks it
- The law sets no fines. A repayment above the caps falls outside what the law allows, so the excess should be void (our reading; no court has ruled).
